Who Can Apply?

Foreign manufacturers seeking certification under the Foreign Manufacturer Certification Scheme (FMCS) must adhere to several requirements:

  • Ensure conformity of their product(s) to applicable Indian Standard Specifications (ISS).
  • Have all manufacturing machineries/facilities at their factory premises.
  • Have all arrangements/equipment in their factory premises for testing of the product(s) as per applicable ISS.
  • Have competent testing personnel in their lab to test the product(s) as per applicable ISS.
  • Accept the Scheme of Testing & Inspection (SIT) and Marking Fee.
  • Accept the Terms & Conditions of the license.
Note: Note: Separate applications are required for each product/Indian Standard and for each factory location manufacturing premise(s).

How To Apply?

To apply for certification under the Foreign Manufacturer Certification Scheme (FMCS), follow these steps:

Fill-up Application Form: Complete the prescribed Application Form provided by the Bureau of Indian Standards (BIS) along with necessary documentation.

Nominate an Authorized Indian Representative (AIR): Nominate an Authorized Indian Representative (AIR) using the prescribed Nomination Form. The AIR will act as an intermediary between the manufacturer and BIS.

Ensure Completeness of Application:Ensure that the application is complete by referring to the checklist of required documents. Incomplete applications may cause delays in processing.

Submit Application:Submit the duly filled-in and complete application along with requisite fees and documentation (in duplicate) to the Foreign Manufacturers Certification Division (FMCD) at BIS Headquarters in New Delhi.

Note:

Before submission, applicants should check for commonly observed deficiencies in applications to avoid delays.

Applicants are responsible for any delays in the grant of license due to incomplete applications, delayed responses to queries, payment of dues, etc

NOMINATION OF AIR (AUTHORIZED INDIA REPRESENTATIVE):

Certainly! Here's a condensed summary of the key points regarding the nomination of an Authorized Indian Representative (AIR) under the Foreign Manufacturer Certification Scheme (FMCS):

Residency

The AIR must be an Indian resident.

Consent and Responsibility

The AIR must consent to and be responsible for compliance with BIS regulations.

Representation Limitation

An AIR can represent only one manufacturing firm under the FMCS

Nomination Criteria

The Incharge of the Indian branch/office of the foreign manufacturer or a senior person should be nominated as the AIR.

Change Notification

Any changes in the AIR or their address must be communicated to BIS.

Conflict of Interest

AIR(s) must not have any conflict of interest regarding their role as AIR and testing in third-party laboratories.

Qualification and Understanding

AIR(s) should preferably be graduates and understand BIS regulations. These points ensure the compliance and effectiveness of the FMCS process.

Grant of License

  • Application and fees received, application recorded.
  • BIS scrutinizes applications, communicates queries via email.
  • Queries addressed satisfactorily, application complete, recorded.
  • Visit to the factory for verification, sample collection.
  • Applicant responsible for safe sample deposition, testing charge remittance.
  • Case processed after satisfactory inspection, test reports.
  • Applicant pays license fee, marking fee, outstanding dues before grant.
  • Agreement, indemnity bond, USD 10,000 performance bank guarantee required.
  • Initial license granted for 1-2 years, renewable up to 5 years.
  • Licensee must disclose production, dispatch details regularly.
  • Licensee can request inclusion of new varieties in existing licenses.
  • Average time for a license grant is around 6 months, subject to various factors.
